Terms of Service
These Terms of Service ("Terms") govern your use of nonstopcustomers.com, its subdomains, and any page or form that links to these Terms (together, the "Site"), operated by UNALOGIX, LLC dba NonStop Customers ("NonStopCustomers," "we," "us," or "our"). By using the Site or submitting a form, you agree to these Terms. If you do not agree, do not use the Site.
1. What we do
We are a lead generation company. We run advertising and consumer websites that collect service requests, qualify them, and deliver them to businesses that buy them from us on a pay-per-lead basis. The Site describes those services and lets businesses contact us, check availability, and model potential results. The Site itself does not sell services.
2. Eligibility
The Site is for business use. You must be at least 18 years old, operate a business located in the United States, and have authority to act for that business. By using the Site you represent that this is true.
3. Written agreement controls
Lead services are provided only under a separate written agreement that sets pricing, lead criteria, service area, delivery, replacement terms, and billing. Descriptions of pricing, lead criteria, guarantees, and features on the Site are summaries. If your agreement conflicts with these Terms, the agreement controls.
4. Your responsibilities when you receive leads
- Legal compliance. You are responsible for complying with all laws that apply when you contact leads, including the Telephone Consumer Protection Act, Do Not Call rules, state telemarketing laws, and CAN-SPAM, and for honoring every opt-out request.
- Use of leads. You may use each lead only to respond to that consumer's request. You may not resell, share, or transfer leads to anyone else, or add them to unrelated marketing.
- Licensing and conduct. You are responsible for holding any licenses and insurance your work requires, and for the work you perform for consumers. We are not a party to any agreement between you and a consumer.
- Data protection. You agree to protect lead information with reasonable safeguards and to delete it on request where the law requires.
5. No guarantee of results
Results depend on factors outside our control, including your market, budget, offer, pricing, reputation, speed of response, sales process, and advertising platform policies. Examples, figures, projections, and calculator results shown on the Site or discussed on a call are illustrations, not promises. Except as stated in a signed agreement, we do not guarantee any number of leads, appointments, jobs, customers, or revenue.
6. Calls and consultations
Calls and consultations are free, carry no obligation, and are offered at our discretion. We may decline or reschedule a call, or decline to serve a business or service area. Nothing said on a call is a binding offer unless it is put in a signed agreement.
7. Communications consent
By providing your phone number or email and submitting a form, you consent to receive calls, text messages, and emails from us about your inquiry and our services, as described in our Privacy Policy, which may use automated technology. Consent is not a condition of purchase. Message and data rates may apply. Reply STOP to opt out of texts, or use the unsubscribe link or contact us to opt out of emails.
8. Acceptable use
You agree not to: use the Site for any unlawful purpose; submit false information; submit forms to gather information for a competing service; copy or republish Site content without permission; or interfere with the Site's operation or security.
9. Intellectual property
The Site and its content, including text, logos, graphics, calculators, and design, are owned by NonStopCustomers or its licensors and protected by U.S. copyright and trademark law. You may view the Site for your own business evaluation. Any other use requires our written permission.
10. Third-party services
The Site and our services rely on third-party providers, including advertising platforms and communication services. Your use of third-party services is subject to their terms, and their rules may affect the services we provide. We are not responsible for third-party services.
11. Disclaimer of warranties
THE SITE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE ERROR-FREE OR UNINTERRUPTED.
12. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, NONSTOPCUSTOMERS AND ITS OWNERS, EMPLOYEES, AND CONTRACTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS OR REVENUE, ARISING FROM YOUR USE OF THE SITE. OUR TOTAL LIABILITY ARISING FROM THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100). LIABILITY FOR LEAD SERVICES IS GOVERNED BY YOUR WRITTEN AGREEMENT. Some states do not allow certain limitations, so some of the above may not apply to you.
13. Indemnification
You agree to indemnify and hold harmless NonStopCustomers from claims, damages, and expenses (including reasonable attorneys' fees) arising from your breach of these Terms, your misuse of the Site, or your contact with, use of, or work performed for leads we deliver to you.
14. Governing law and disputes
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules. Any dispute arising from these Terms or the Site will be brought exclusively in the state or federal courts located in Travis County, Texas, and you consent to their jurisdiction. Before filing any claim, you agree to contact us and attempt in good faith to resolve the dispute informally for at least 30 days.
15. Changes
We may update these Terms at any time by posting a new version with a new effective date. Continued use of the Site after a change means you accept the updated Terms.
16. Miscellaneous
If any provision is unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. These Terms, together with the Privacy Policy and any signed agreement, are the entire agreement between you and us regarding the Site.
